美團和餓了麼迴應偷聽質疑

The report said when the author talked to others that she wanted to eat Japanese cuisine, the app recommended a Japanese restaurant to her just two minutes later.

報告稱,當記者和他人提及她想吃日料時,餓了麼就會在兩分鐘後向她推薦日料店。

She then tested some other keywords, including "Hong Kong food" and "tea shop". Sure enough, a few minutes later, the author found the mentioned food was placed in the top of the app's restaurant suggestions, even though she had never ordered it before.

之後,她又測試了“港式茶點”、“茶館”等關鍵詞。果不其然,幾分鐘後,相關餐廳位列平臺推薦榜首,而她之前從未點過這些食物。

According to the author's 3-month research, more than 70 percent of food or restaurants that she talked about appeared in the recommended places on the two delivery apps.

記者歷時三個月的調查發現,她曾提及的食物或餐廳超過70%都出現在兩款外賣軟件的推薦裏。

Meituan said that they never collected users' voice data to recommend services. Only when users are actively searching for food or restaurants, will they make relevant recommendations.

美團稱他們從未收集用戶語音數據來推薦服務。只有用戶頻繁搜索某些食物或餐館時,美團纔會做出相關推薦。

" hasn't made such product settings, and from a technical perspective, the company is unable to do so," it said.

餓了麼說:“餓了麼沒有此類產品設置,也不具備相關的技術條件。”

However, some tech experts disagree. Liu Quan, a senior researcher in China Center for Information Industry Development, told China Daily that there is no technical barrier for tech companies to make recommendations based on the voice information without users' permission.

然而,一些技術專家卻不同意這一點。中國電子信息產業發展研究院高級研究員劉權告訴《中國日報》,科技公司未經用戶允許根據聲音信息做出推薦不存在技術障礙。

Zhao Lei, a partner lawyer at Beijing Zewen Law Firm, said that if internet companies obtain users' information without the latter's consent, that might violate the law, and could even bring criminal charges to the company involved. However, that would require very exact evidence, which could be hard to collect.

北京市澤文律師事務所合夥人律師趙磊稱,如果互聯網公司未經用戶允許擅自獲取用戶信息,可能會違反法律,甚至會對涉事公司提起刑事訴訟。然而,這需要確實的證據,而這些證據很難蒐集。
