華爲公司起訴三星侵犯專利

According to Huawei, several of its cellular communications and software inventions had been used in Samsung's phones without its permission. Samsung told the BBC it would defend its business interests.

華爲公司近日聲稱,該公司的幾個蜂窩通信系統和軟件發明都在未經同意的情況下被三星手機使用了。而三星公司則在接受BBC採訪時表示,它會捍衛自己的經濟利益。

The specific patents involved have not been disclosed. However, Huawei has said at least some of them are classed as Frand - an acronym referring to "fair, reasonable and non-discriminatory".

據悉,具體的專利項目目前並沒有公開。但是華爲卻表示,至少其中一些類目被歸類爲Frand專利——“公平,合理和非歧視”的縮寫。

This means the Chinese company has committed itself to offering anyone a licence so long as they agree to a non-excessive compensation.

這意味着該中國公司會爲任何人提供使用權,只要對方同意支付非過度的費用。

This kind of agreement is common in the tech sector as it makes it possible for different companies' products to communicate and share data formats with each other.

這種協議在技術領域很常見,因爲這讓不同的公司的產品得以交流,相互間分享數據格式。

Huawei's intellectual property chief indicated it was seeking permission to use some of Samsung's technologies in return rather than seeking a payment.

華爲的知識產權主管表示,該公司目前正在尋求批准,通過使用三星的技術作爲回報,而不要求對方支付費用。

"Thus far, we have signed cross-licensing agreements with dozens of our competitors," said Ding Jianxin. "We hope Samsung will respect Huawei's R&D investment and patents, stop infringing our patents and get the necessary licence from Huawei, and work together with Huawei to jointly drive the industry forward."

“到目前爲止,我們已經與數十家競爭對手簽訂了交叉授權協議,”丁建新說。“我們希望三星公司能夠尊重華爲的研發投入和專利,停止侵權我們的專利,並從華爲獲得必要的許可證,與華爲攜手合作,共同推動行業向前發展。”

A Samsung spokesperson responded in an email to the BBC saying "we will thoroughly review the complaint and take appropriate action to defend Samsung's business interests".

One expert noted that just because papers had been filed in the latest case did not mean Huawei and Samsung would necessarily fight a similar battle in public.

"Huawei may have initiated litigation as lever to get a settlement," commented Ilya Kazi from the Chartered Institute of Patent Attorneys. "We don't know if it intends to go all the way through. Most cases do settle."
