三、離婚
在美國，當事人雙方婚姻關係的解除必須經過法庭判決。
1、管轄法院：
在美國，離婚訴訟應向夫妻一方所在地法院提起。而美國絕大多數州都規定，當事人必須在本州居住滿一定期限後，才能具備在該州提起離婚的權利。不過，各州對於該居住期限的要求並不一致，短的
有6周時間，而長的也有6個月。
2、離婚程序：
在美國，離婚訴訟程序分爲兩種，即簡易離婚程序(Summary Dissolution Procedure)和普通離婚程序(Regular Dissolution Procedure)o簡易離婚程序雖然比較簡捷方便，但各州卻設定了一定的適用
條件，同時也對當事人的權利作了一定的限制性規定。
在離婚程序中，爲協助當事人儘早達成一致協議，特別是關於子女監護與探視問題的解決，大多數州的法院還設置有調解程序。
爲保護當事人的人身和財產安全，美國各州均設定有禁止令制度。當事人可在離婚訴訟過程中要求法院發佈禁止令，如禁止原配偶騷擾、妨礙其生活，禁止任何一方在未經對方同意或法院允許的情況下
